I was looking at the declaration on a subdivision plat earlier today and saw:   

 "10. No race or nationality other than Caucasians shall     use or occupy any building or lot except that this covenant shall not prevent occupancy by domestic servants of a different race or nationality emplyed by an owner or tenant."

Signed by several people but one is Roy Hofheinz, County Judge.

This neighborhood was platted in 1938.

I look at maps all day. This is the first one where I noticed that statement in the declaration, though I know it is far from the only one having it.

The neighborhood I grew up in in Maryland used to be like that, though that was long before my folks moved there in the 70s. Even so, while I was growing up the area was still mostly white, which was weird because the rest of southern Montgomery County is largely black and Hispanic. That's changed substantially in the last decade or so, though.

nope, public record. They will not replat the subdivision if the maps burn up...hence my hate of anything in galveston county. They platted very few subdivisions and a lot have been destroyed.

Up until 50 years ago in the northeast there were frequently "covenants" attached to real estate transactions to prevent the future sale of the property to Jews and Blacks. Had my grandparents at age 32 tried to move to the suburb where my parents moved from NYC at that age they would have had a hard time finding a seller willing to sell to them. Our neighborhood was one of the first integrated suburbs in the 1960s, and when I would chide classmates from a lilly white neighborhood they would all claim Ossie Davis and Rubie Dee as their token black neighbors. As late as the 1970s the first time I was in grad school a WASP classmate from CT mentioned that Leonard Bernstein was the first and only Jew allowed to move into his parents' neighborhood.
